Impact of WAC 388-76-10685

Important WAC change notice

As was recently reported in our newsletter WAC 388-76-10685 (7) changes effective April 1, 2016. The change requires providers to offer and supply door locks for residents.  The Council recognizes that this change has a potential financial impact on our members.  Therefore, the Adult Family Home Council has filed a “demand to bargain” regarding the impact of this rule.  It is our intention that for all state funded residents requesting a door lock, DSHS would be required to pay for any modification of an existing door, including new hardware, keys, labor, and even door frames and doors in some situations.  These negotiations are ongoing and will not be resolved before the April 1st implementation date.

The Call to Action:

In the meantime, if you have a Medicaid resident request a door lock for an interior bedroom door, and it requires you to spend money to modify the door or hardware, request from your case manager an ETR for cost of the materials and labor. Even if you are denied this ETR, please keep any receipts related to the expense and contact the council to let us know how this rule change has impacted you.

It is not fair for DSHS to hand down this unfunded requirement without creating a means to reimburse providers for their expense. As always, if there are any questions, please contact us.

  1. So how does this work? Are we supposed to ask each resident and family if they would like a lock on their bedroom door and then what document if they do or don’t.?

  2. About time they keep changing things and have no means or any ideas how costly these items cost.
