Ensuring Compliance with Personnel Record Requirements

WAC 388-76-10198 is aimed at enhancing the management and accessibility of personnel records (your staff) in adult family homes. These regulations are crucial for maintaining high standards of care and ensuring compliance with state requirements.

Key Requirements

1.  Accessibility of Records: Adult family homes must keep all staff-related documents in a location that is easily accessible to authorized department staff. These records must be maintained throughout the staff’s employment and for at least two years after their employment ends

2. Comprehensive Staff Information: The records must include essential staff information such as addresses and contact details. Be sure to include:

  • A photocopy of employee’s picture ID
  • W-2 and I-9 forms (completed by employee)
  • Application for employment

3. Training and Orientation Records: Detailed records of staff orientation and training pertinent to their duties are required. This includes:

  • Training mandated by chapter 388-112A WAC (AFH facility orientation, basic or modified basic training, specialty training, nurse delegation core training, and continuing education)
  • CPR and First Aid certifications
  • HIV/AIDS training (blood borne pathogens training)
  • Food Handling
4. Health and Safety Documentation: Results of tuberculosis (TB) testing must be documented and readily available. Reminder – employees need to be tested for TB within 3 days of hire!

5. Background Checks:

  • Washington State Name/DOB background check
  • Federal fingerprint background check

These procedures are designed to ensure AFHs are well-prepared to provide safe and effective care to their residents. By maintaining thorough and accessible personnel records, providers can demonstrate their commitment to compliance and quality care.

Adult family home—Personnel records.

The adult family home must keep documents related to staff in a place readily accessible to authorized department staff. These documents must be available during the staff’s employment, and for at least two years following employment. The documents must include but are not limited to:

(1) Staff information such as address and contact information.

(2) Staff orientation and training records pertinent to duties, including, but not limited to:

(a) Training required by chapter 388-112A WAC, including as appropriate for each staff person, orientation, basic training or modified basic training, specialty training, nurse delegation core training, and continuing education;

(b) Cardiopulmonary resuscitation;

(c) First aid; and

(d) HIV/AIDS training.

(3) Tuberculosis testing results.

(4) Criminal history disclosure and background check results as required.
