Important Overpayments Changes

Effective April 19, 2022, DSHS should no longer be issuing Vendor Overpayment Notices to adult family home operator.  This is a temporary action while DSHS corrects some fundamental flaws in the overpayment process. If you receive an overpayment notice, please contact our office.

Why is this happening?

For more than three years the AFH Council has been advocating for improvements in the overpayment process.  We have observed many providers receiving inaccurate overpayment notices.  Notices have requested thousands of dollars that providers are not responsible to pay back. The notice itself fails to meet the legal requirements of a vendor overpayment notice.  The information provided does not adequately allow a provider to even understand why the alleged overpayment is being issued. DSHS case manager have violated the rights of AFH operators when insisting on repayment, without providing the opportunity for an appeal.  Through the administrative appeal process, we have been successful at getting these overpayments dismissed. However, we believe they never should have been issued. 

We are grateful to the member who brought these issues to our attention.  Through our work on your behalf, we have been able to hold the state accountable to develop a fair and transparent process. We will keep you up to date with changes in the process as they develop.

  1. This is really welcome. The casemanagers some of do not read the emails especially when you report a client who has been admitted to a hospital. Provider keeps on informing the casemanager about the client till the discharge, but you still hear ” You did not keep the bed on hold”. Next thing that happens a mail of overpayment.

  2. Thanks. This is a milestone.The confusion surrounding the issue is very upsetting. When providers ask the case managers what the overpayment is for, they do not have an answer. The process of determining what caused the overpayment is so long and the overpayment reminders still continue coming. Thanks for a good job.

    Thank you for bringing this up, how can the aggrieved be reimbursed, our home was a victim of this reclaim as having been overpaid despite the fact that DSHS were already aware that we had a bed hold. Months after the resident went to a rehab, they sent the claim notice. we had no recourse than issue the check.

  4. How about what was already paid by AFH providers, will the state be able to pay it back or that is already gone? Please advise? Thank you

  5. I have received so many of these overpayment notices which I paid because I got frustrated. Just received another that I am not sure of.So happy to hear that AFH council is looking into it. Thanks
