On June 6, 2023, the Department of Social and Health Services (department) filed a CR-103P (permanent rule) amending chapter 388-76 of the Washington Administrative Code (WAC) of the adult family home licensing rules.

This rulemaking

  • incorporates ESHB 1023, 2020 Regular Session, into the rules, allowing certain adult family home providers to increase their capacity from six residents to eight;
  • helps adult family homes comply with liability insurance requirements;
  • clarifies use, implementation, and enforcement of management agreements; and
  • creates a process for adult family home providers to request an exemption to rule.

 

A public hearing was held March 21, 2023. Residential Care Services did not receive any comments on the proposed changes.

The adopted rules are published in the Washington State Register under (WSR 23-12-075). The permanent rule won’t appear online for at least two weeks after the full text of the rule is published in the Washington State Register. The rule became effective August 1, 2023.

  1. I’ve an application in for 7-8 bed capacity increase – two months not acknowledged. This is good development.
